:mad: October 8th, 2002, at the VAMC in Long Beach Calif. my dear friend, Gary C. died due to negligence of a nurse while on the spinal cord injury ward. He had been a patient at the VAMC L.B. for years. An injury occurred at a motel while his common law wife (which they had been together for a period of 7yrs, known 9-1/2yrs.) and she was his caretaker, in home. They were travelling to go see his Brother, retired Navy, in Washington. They stopped at a motel chain. The wheel chair ramp was inadequate, in fact, rotten, and as he tried to go up, in gave way, causin' him to go overbackwards and his heavy wheel chair fell on him. A suit ensued settling for $70k, of which 33-1/3rd % went to the lawyer, and another couple grand went to another lawyer. His common law wife, didn't want any money, as her husband would want his two children from a previous marriage to have what they could get which was approx 7k each.
After recouping from his injuries, broken bones, etc., which he couldn't feel, but the toll did take it's effect, he wanted to go back to Long Beach and taken to the VA there as he knew the people. He ws taken there. Due to a "STUPID IDIOTIC, DIPWAD LAZY ASS NURSE" his distress calls were ignored, then he was given an OVERDOSE of some relaxing medication, without any Dr.'s permission. The lady lawyer told her, that she could not have any part of suing the VA, as she was common law wife. They didn't even notify her of his passing until 4-5hrs after. She is then let his Brother begin the suit. He wants to take their offer, "IF YOU DROP THE LAWSUIT, WE WON'T CHARGE YOU 8K for his care." "WHEN IN FACT, THERE'S NEVER BEEN ANY CHARGE FOR HIS CARE FOR OVER 10-12yrs at this same VA. The common law wife wants to continue the suit, so this won't happen again. I feel for the people who lost their loved one who died because of Neglect, which is so outrageously inheritant in so many VA's. Veterans are treated as second class citizens, and our "WONDERFUL ELECTED OVER-PAID LAZY BUNCH OF PINHEADS' in Washington, keep taking more and more away from the VA bduget. I hope with all that I have in me, they get 5MIL PLUS!!!!!! I have investigated this common law on the net, and found her a lawyer, who has represented over 1k people and has never lost. I'm going to give her this name, and she wants to begin a suit against this IGNORANT NURSE, for a "WRONGFUL DEATH CIVIL SUIT." If anyone on this site can get me more info., on common law wives rights in the State of Calif., I would appreciate it. She and my friend were two people who gave of themselves. My friend never complained of being a quad-palegic. He gave classes, told his story of spousal abuse, his first and 2nd wife, with a grant a DAMN GOOD NURSE AND HIM WORKED TOGETHER, to get, and he travelled around the country telling his story...Gary was one of the smartest people I've ever known. And he gave of himself. People came first, and he never ever bragged on boasted of his accomplishments to make any SPI ward and care he talked about and helped to get changed. He had so much more to give, and I couldn't go his memorial service which was held at the VAMC L.B. A video and a portfolio of him was given. His wife and I are in contact still. I hate the knowing that our Military people who will come back and expect good care, and it won't be there as "PROMISED." It's a total slap in the face to those who so proudly, bodly served like my friend Gary, a corpsman, wounded in the early times of our conflict/war, In the Nam. Please, I'm begging, anybody who can help this woman with any information, constitutional law, state laws, fed. laws, lawyer's who would be willing to take her case, pro-bono, get back to me......IT IS TIME US VETERAN'S WHO USE/DON'T USE THIS SERVICE WE WERE PROMISED, TAKE A STAND AGAINST THIS TYPE OF INADEQUATE SERVICE.
