Schumer to sponsor Sgt. Carmelo Rodriguez bill in Senate
WASHINGTON – US Senator Charles Schumer Wednesday announced that he would introduce the Carmelo Rodriguez Military Medical Accountability Act in the Senate.
The bill, drafted and carried in the House by Rep. Maurice Hinchey of Hurley, would give military service members the right to pursue civil actions against the military for medical negligence suffered while receiving treatment for injuries unrelated to their service.
Hinchey named the bill after the late Sgt. Rodriguez of Ellenville, who was misdiagnosed and died of cancer while serving in the Marines in Iraq.
Under a US Supreme Court decision in 1950, service members may not sue for medical negligence by military doctors.
