An ex-Marine whose tour of Iraq prevented him from settling a seven-year-old court case was jailed for 15 days Friday in Sarnia court.

Zachary Riley, 29, of Wallaceburg, pleaded guilty to being unlawfully at large related to a 2001 conviction in Chatham- Kent.

During the intervening time, Riley spent four years in the U. S. Marines, had two children and enrolled in a college program.

It's odd the Marines would take somebody with an outstanding warrant, said Justice Mark Hornblower.

Riley had been sentenced to 21 days of weekend jail for an assault. After two weekends, he wasn't back in court until 2006.

He was released on bail then and wasn't back until May.

"There's quite a history to these 21 days," noted assistant Crown attorney Aniko Coughlan. She called for a 60-day sentence to show Riley he can't escape court sentences.

Following his military service, there was time when he might have cleared up the matter, she said.

"I didn't want to go to jail," Riley told the court.

Defence lawyer David Burns asked for leniency, noting Riley isn't the same person who was sentenced in 2001.

He is enrolled in a college co-operative program that had him working at a Chemical Valley plant.

The offence demanded jail time, but on the low end of the scale, said Hornblower.

In addition to the 15 days, he must also complete the remaining time on the 21-day sentence.
