Vacation pay in question for marine

NORWALK -- The Huron County Sheriff's office is seeking a legal opinion concerning whether Deputy Todd Corbin will have to use his vacation time when he leaves for training in preparation for another round of service in Iraq with the Marines.
Sheriff Dick Sutherland, Dick Gortz, the county's personnel consultant, and Justin Burnard, an attorney who represents the Ohio Patrolmans Benevolent Association, met Tuesday on the matter, said Burnard.

The sheriff and Gortz told Burnard they were referring the matter to the county prosecutor's office to interpret Ohio's provision concerning compensation of public employees who are in the service.

Meanwhile, Corbin is scheduled to leave Saturday and his return date is listed at the sheriff's department as June 30, according to a sheriff's office employee.

Sutherland and Gortz maintain the law dictates Corbin should only be paid his salary when he is off work to perform military duty for 176 hours. Corbin reached that mark recently and was told by the sheriff's administration that he will be paid with his vacation or personal time until it runs out.

The union maintains Ohio law provides for the sheriff and county commissioners to use their ''legislative authority'' to pay Corbin his full wages.

Sutherland hasn't approached the commission board about Corbin's pay issue, the commissioners said.

Corbin, who wasn't available for comment yesterday, would like to be paid his full salary and is working with the union to challenge the sheriff's decision.

''Todd wants this looked into. We're acting in his best interest, on his behalf, at his direction. This just didn't come up out of the middle of nowhere. ... Todd assumed everything was being taken care of in the manner it was supposed to be taken care of and now there's a possibility that it wasn't. He may ahave some money coming to him and I assure you that if he has money coming to him, he would like it,'' said Burnard.

The union is also researching whether Corbin should be paid wages that were held in the past year's while he missed work to serve in the military, said Burnard.
