The owner of the carnival located in the Jacksonville Mall parking lot last weekend didn't have a permit necessary to operate in the city.

Powers Great American Midways of Burgaw, the same company that provided the midway for last year's State Fair in Raleigh, didn't have a public assembly permit, which is a requirement to run a carnival, according to a city ordinance.

The carnival, which opened March 1, was shut down Saturday by Jacksonville police shortly after 15-year-old Christian Cardenas was stabbed to death in the parking lot near the carnival. The carnival was supposed to operate until this weekend.

Jacksonville police are investigating why Les Powers, owner of Powers Great American Midways, didn't have a permit, said Chief Michael Yaniero, who is responsible for issuing the permit.

Yaniero said he couldn't comment any further on the matter because it was under investigation.

Anyone who is convicted of violating the provisions of the city's parade and public assembly ordinance could be fined up to $500 or imprisoned up to six months, according to city ordinances.

Powers, who has run a carnival in Jacksonville in the spring for the past 12 years, said he didn't know he needed the public assembly permit. Before moving to the mall location, the carnival operated in the flea market that used to be located where Home Depot is now.

"We had every permit we thought we needed," said Powers, indicating he had a city license, privilege license as well as permits from the state Department of Labor, Onslow County Heath Department and Jacksonville Fire Department.

"Those were the ones we had and always had," Powers said. "If there was something we needed, we would have certainly done it."

After the stabbing took place at about 8:43 p.m., policed arrived on the scene. At some point during their investigation Saturday night, officers asked to see Powers' paperwork.

"They told me there wouldn't be a problem getting it, but I needed to apply for it 10 days in advance," Powers said.
