Government sued over traffic accident

JACKSONVILLE, N.C. - A civil lawsuit claims the Marines are responsible for allowing a Camp Lejeune Marine involved in a fatal traffic accident access to ether even though he had a huffing addiction.

The lawsuit against the federal government was filed last month on behalf of the five wreck victims. One person was killed and four others were hurt in the accident, which occurred in November 2004 on N-C 24.

Former Private Lucas Borges was convicted last June of second-degree murder and other charges, and is serving a 24- to 32-year sentence in a civilian prison.

Borges was assigned to Second Maintenance Battalion. The lawsuit says blood tests showed he was, quote, "severely intoxicated due to the inhalation of ether."

Marine Corps officials discovered that Borges inhaled ether that was stored in lockers located in the battalion work space.

The Marines say there's no evidence that Borges was acting within the scope of his duty at the time of the accident.
