Mayor Won't Give Dead Marine's Money Back
Bostick Is Mayor Of Fort Lupton

FORT LUPTON, Colo. -- The mother of a U.S. Marine was grieving for her dead son when she found that his savings account had been claimed by the director of the funeral home.

It was money that he had no right to and despite a court ruling, the funeral director refused to pay. What's even more puzzling is that he's not just any debtor, he's the mayor of the small town and a member of a City Council that has financial responsibility for the city's budget.

7NEWS also found that he has other debts as well, something his constituents may want to know.

Jason Sepulveda, a Marine, was training at Camp Lejune in North Carolina, preparing to go to Iraq, when in an evening off-base, he was killed in a car accident.

"My son died instantly and the other Marine died approximately two weeks after," said Elis Sepulveda, Jason's mother.

His parents, who spoke with him weekly, knew he had been saving his money for a long weekend when they would all be together.

"We were going on vacation for the Fourth of July to visit him," Sepulveda said. "I know he had been sacrificing because they don't get paid very much."

Jason's body was returned to Colorado for burial. Records show that the funeral was paid, in full, by the Marines. But after closing out her son's accounts, Jason's mother realized that the probate court had sent the proceeds of Jason's savings account to the funeral home, which is run by Jim Bostick.

"I called Mr. Bostick and I said, 'Well, the courts sent you my son's savings account.' He just kind of really blew me off a lot," Sepulveda said.

She said he didn't give her any receipts or bills and just kept the money.

In addition to his duties as mayor and member of the Ft. Lupton City Council, Bostick also owns two funeral homes. In his role with the city, he is heavily involved in overseeing the finances of the town.

Sepulveda took Bostick to court over the money he wouldn't return to her family. The judge's order in the case was final.

"She gave damages, interests, court fines, everything, and I assumed that if you go to court that you pay it," Sepulveda said.

But despite the judgment of more than $7,500, Bostick has refused to pay.

When 7NEWS Investigator John Ferrugia confronted Bostick and asked him why he was still holding money from the Sepulvedas, Bostick said, "I'm not holding the money for them. I don't want to be on camera right now."

But Bostick not only owes the Sepulvedas, he owes other people money.

"You've got other judgments out there. Do you want to talk to me about that?" Ferrugia asked Bostick.

"No, I don't," Bostick said.

In fact, court records show Bostick has several current unsatisfied debts to creditors from Greeley to Montana and that doesn't include money he owed when he filed bankruptcy in 2001. He claims he is trying to repay the money.

But Bostick didn't want to talk about the money he owes the Sepulveda family or whether, given his personal financial problems, he should be making fiscal decisions for the town of Fort Lupton.

"I want to know if you think it's appropriate for the mayor who has fiduciary responsibility to owe this kind of money," Ferrugia said.

7NEWS obtained letters written by Bostick to the family, saying that he would settle the debt.

"It got to the point where he would just not accept our phone calls and just say, 'I can't hear you, I can't hear you,'" Sepulveda said.

"You wrote. You said, 'I want to settle this,' and you never have. Why not?" Ferrugia asked Bostick.

"I don't recall ever writing letters to ..." Bostick responded. "Well, I don't recall that, no. Right off, I don't recall it."

Finally, using the same double-talk that has frustrated the Marine family, Bostick seemed to make clear he has no intention of settling the claim.

"It will be worked out with them," Bostick said.

"Worked out? You've been saying that for how many years? How many years have you been telling them that?" Ferrugia asked.

"I can't even remember when it happened," Bostick said.

"It's not a real top priority, is it?" Ferrugia said.

"Yes, it is a priority and I feel that it's money that I do not owe them," Bostick said.

"My son was in the Marines and he went there to do what was right for his country. I know for a fact that for somebody to actually steal from him is not right," Sepulveda said. "I feel like me, as a mother, I need to do this. This was my son's money and I'm not going to go away."

The mayor broke two appointments with 7NEWS and refused to talk with us before Ferrugia decided to go to City Hall for some answers. Despite his pledge to settle the issue, Sepulveda said Bostick still has not contacted her.

And despite his apparent questionable financial judgment, he is still involved in making fiscal decisions for the citizens of Fort Lupton.

Is the legal representation for the Sepulveda family asleep at the switch? The court has ordered payment, and payment is not forthcoming. A lump sum or a payment schedule, if that is acceptable to the Sepulveda family, should be worked out, or the funeral director's assets should be dissolved to satisfy the debt(s). If the mayor/funeral director had no assets or had declared bankruptcy, the issue might be considered differently, but he has not conducted himself ethically and, on that basis, should be in violation of court order. Or does this town have the best courts money can buy?

Cowboy is right on target. This is a case for the Attorney General's office in the deceased Marines's state. If I were this scumbag mayor and funeral director I'd be "sleeping with one eye open". Believe me, Bros, nobody more than myself would like to hit a home run with this guys head, but you can't do that . Trust me; justice will be served. But don't rule out the blanket party down the line. Hopefully, some people in his town (notice I didn't say Marines) will get around to it. I hope they know enough to use Fels naptha soap. It's real hard and should have a wonderful effect.:devious:

I have just written the Mayor and tried to be a gentleman about the whole thing, and I ask you have I done the right thing. If I have, let the city council know and ask them to act on this problem. Say huraah to the Brothers of the marine Corps. The Following is a draft of the letter I wrote.

I don't know why you took our Brothers money, but it seems to us that if you have any type of humanity left in you, you will settle with the Sepulveda Family and ask for the Nations forgiveness. You not only have to deal with the Sepulveda's Family, but you will hear from the Nations Family as well.Please help our Brothers Family out.Be A Man, not a mouse.

Having been in the same platoon with LCpl Sepulveda I want to say thanks for getting involved in this. What is being done to the Sepulveda family is wrong I gave the eulogy at the Camp Lejuene Memorial service for Lcpl Sepulveda he was a great Marine who was part of 2nd Mar Div 2nd LAR BN Security PLt more than all that he was my friend. He deployed once to Norway and was preparing for a possible deployment to Iraq. He is very important to me and I want you guys to know we have to make this right any way we can.

FORT LUPTON, Colo. -- The mayor of Fort Lupton, who operates two funeral homes, has been afforded police protection after receiving death threats following a 7NEWS investigation that revealed he has refused to repay money illegally kept from a U.S. Marine who died.

"I've been getting a lot of phone calls from a lot of different people, a lot of threats," said Jim Bostick, the mayor of Fort Lupton.

Bostick is worried about his personal safety and that of his business and he now admits he made a big mistake.

"It's my fault ... I will try to do whatever I can with Mrs. Sepulveda to get this issue put to bed," Bostick said. "As soon as I get the money, it's her's. I mean, fast. Because, you know, I can't keep putting up with the threats against myself and my family."

While he may be sincere this time, Bostick claims he doesn't have $7,500 a Weld County court said he owes Elis Sepulveda.

Sepulveda is the mother of a U.S. Marine who was killed in a car accident and brought back to Fort Lupton for burial. Jason Sepuldeva's savings were sent to Bostick's funeral home. It was money Bostick had no right to but he refused to return it.

"He was the person who received the money," said Magistrate Rebecca Koppes Conway. Conway assessed the judgment against Bostick in small claims court but can't force him to pay.

"This is not a criminal matter. The only time that people get arrested for not paying their bills is if there is an order of the court to pay and there is a contempt citation and then there's a finding after that the person is in contempt," said Conway.

Bostick has many outstanding debts including more than $11,000 he owes in child support. 7NEWS has learned his mayoral paycheck is garnished monthly.

But he said he hasn't decided yet if if he going to resign as mayor.

"My personal financial issues have nothing to do with my job as mayor," Bostick said. "My intentions were not to screw over a Marine veteran. You know, I'm a veteran myself. I take care of veterans everyday."

"So why didn't you just pay it?" 7NEWS Investigator John Ferrugia asked.

After a long pause Bostick said, "I should have."

Several city officials are urging the Fort Lupton mayor to pay the Sepulvedas as soon as possible, hoping that the firestorm, which has nothing to do with city business, will subside.

As one official put it, "This has nothing to do with the Marines vs. Fort Lupton. This is about how Jim Bostick is doing his private business."

A litttle fear is a healthy thing...... isn't that part of the survival instinct? I suspect this dirt bag is worried because he has been caught. If he repays the money ..... he can slither away in safety. If not .... I think things will get more intense.

I hope he remembers this little exercise in education. The point of the class being "Don't f#*k with the Marines".

I feel that if this Mayor in Col. has no more respect for a man stands up and offers his life to defend this country, then he has no respect for anyone. This sorry excuse for a man should be taken out, either by the citizens, by the law officials of the town, by pressure from the Marine Corps, or even the U.S. government. If nothing else, this sorry of an excuse for an American (or is he?) should have his name drug through the mud through out this country.

I guarantee you this piece of garbage is not going to get reelected , wich is one hundred percent fine. His house probably already has liens, and judgements on title, and since hes already getting his paycheck garnished he probably has no other ways to get that money repaid. Eventually he'll file bankruptcy, get his home forclosed on on and that will probably be the only way the family will get their money back....maybe. Depending on what lien position on title theyll be . Very unfortunate that no one ever before noticed what kind of scumbag they elected . What a complete piece of garbage.

I to am a little late on the subject. What a complete idiot. I suggest not only emailing this guy but also the larger media sources. I just sent an email to oreilly@foxnews.com I belive with enough pressure from Veterans he will report the story and the issue will get resolved. We can increase the pressure and he will find a way to get the money he owes to this family.

Fort Lupton Mayor Resigns After 7NEWS Investigation

DENVER -- The mayor of Fort Lupton has resigned citing health issues and media attention.
Jim Bostick was under the microscope for taking money from a dead U.S. Marine.
Bostick was not only the mayor, but operates a funeral home in Fort Lupton. The personal savings account of Marine Jason Sepulveda was sent to Bostick for Sepulveda's funeral after he was killed in an accident.
The U.S. government paid for the Marine's funeral, yet Bostick refused to return the dead Marine's personal savings to his family.

Bostick even ignored a court judgment that totaled more than $7,500. 7NEWS' stories caused a national uproar against Bostick. Hundreds of e-mails were sent to the city of Fort Lupton calling for his resignation.
In his letter to the Fort Lupton City Council he said, "It is with great sadness that I am writing this letter but with all that has gone on with the recent events and my health, I feel it is the best interest of the city and myself to resign my post as mayor for the City of Fort Lupton. I believe in this town and I am very proud of the way the town is moving ... It has been a great pleasure to have served and worked with each and every one of you."
Bostick told 7NEWS Investigator John Ferrugia that threats against his life, and pressure from constituents, caused him so much stress he had to be taken to the hospital in the past few days with high blood pressure.
He said his doctor told him to continue as mayor could kill him.
However, Bostick said he doesn't have the money to pay back the Sepulvedas and has not paid them yet.
