Mexican Constitution's Solution to US Immigration Policy

The Congress has received lots of free advice lately from Mexican government officials and illegal aliens waving Mexico's flag in mass demonstrations coast-to-coast. Most of it takes the form of bitter complaints about our actual or prospective treatment of immigrants from that country who have gotten into this one illegally — or who aspire to do so.

If you think these critics are mad about US immigration policy now, imagine how upset they would be if we adopted an approach far more radical than the bill they rail against which was adopted last year by the House of Representatives — namely, the way Mexico treats aliens.

In fact, as a just-published paper by the Center for Security Policy's J. Michael Waller points out, under a constitution first adopted in 1917 and subsequently amended, Mexico deals harshly not only with illegal immigrants. It treats even legal immigrants, naturalized citizens and foreign investors in ways that would, by the standards of those who carp about US immigration policy, have to be called "racist" and "xenophobic."

For example, according to an official translation published by the Organization of American States, the Mexican constitution includes the following restrictions:



• Pursuant to Article 33, "Foreigners may not in any way participate in the political affairs of the country." This ban applies, among other things, to participation in demonstrations and the expression of opinions in public about domestic politics like those much in evidence in Los Angeles, New York and elsewhere in recent days.

• Equal employment rights are denied to immigrants, even legal ones. Article 32: "Mexicans shall have priority over foreigners under equality of circumstances for all classes of concessions and for all employment, positions, or commissions of the Government in which the status of citizenship is not indispensable."

• Jobs for which Mexican citizenship is considered "indispensable" include, pursuant to Article 32, bans on foreigners, immigrants, and even naturalized citizens of Mexico serving as military officers, Mexican-flagged ship and airline crew, and chiefs of seaports and airports.

• Article 55 denies immigrants the right to become federal lawmakers. A Mexican congressman or senator must be "a Mexican citizen by birth." Article 91 further stipulates that immigrants may never aspire to become cabinet officers as they are required to be Mexican by birth. Article 95 says the same about Supreme Court justices.

• In accordance with Article 130, immigrants — even legal ones — may not become members of the clergy, either.

• Foreigners, to say nothing of illegal immigrants, are denied fundamental property rights. For example, Article 27 states, "Only Mexicans by birth or naturalization and Mexican companies have the right to acquire ownership of lands, waters, and their appurtenances, or to obtain concessions for the exploitation of mines or of waters."

• Article 11 guarantees federal protection against "undesirable aliens resident in the country." What is more, private individuals are authorized to make citizen's arrests. Article 16 states, "In cases of flagrante delicto, any person may arrest the offender and his accomplices, turning them over without delay to the nearest authorities." In other words, Mexico grants its citizens the right to arrest illegal aliens and hand them over to police for prosecution. Imagine the Minutemen exercising such a right!

• The Mexican constitution states that foreigners — not just illegal immigrants — may be expelled for any reason and without due process. According to Article 33, "the Federal Executive shall have the exclusive power to compel any foreigner whose remaining he may deem inexpedient to abandon the national territory immediately and without the necessity of previous legal action."

The Bottom Line

As the immigration debate in the Senate moves into a decisive phase this week, legislators who believe America's southern border must be secured, the Nation's existing immigration laws enforced and illegal aliens not rewarded with permanent residency and a direct path to citizenship are being sharply criticized and, in some cases, defamed as bigots and xenophobes. Yet, even their maximalist positions generally pale in comparison with the treatment authorized by the Mexican constitution.

So the next time such legislators — and the majority of Americans for whom they speak — are assaulted by Mexican officials, undocumented aliens waving Mexican flags in mass demonstrations here in the United States, clergy and self-described humanitarians, businessmen and other advocates of illegal immigration ask them this: Would they favor having the US impose the same restrictions on immigrants — legal and illegal — that Mexico imposes on their counterparts there?

Nothing of the kind is in the cards, of course. Nor should it be. Legal immigration and the opportunity for foreign investors and other nationals legitimately to contribute to this country are not only one of its hallmarks; they are among the reasons for its greatness.

Still, we should not allow the hypocrisy of others' treatment of undocumented aliens in their countries to induce us to refrain from taking effective steps to prevent further illegal immigration: by building a fence along our southern border; by enforcing immigration laws in the workplace and elsewhere; and by discouraging more such violations — with potentially grave national security implications — by dealing effectively with those who have already broken those laws by coming here without permission.

Totalling the amount of showboating and fabrications that this issue has surfaced, we have a definate two sides of the story. The American side saying that we as Americans should just " suck it up " and allow those already here to work and live here as normal individuals under specific rules and regulations. Now also having parts of the Mexican Constitution, I think we should we think the prior. On the Spanish channel, channel 22 where I live, I didn't understand what they were saying but the scenes said it all. There was a demostration concidered illegal by the Mexican government because it was held by foriegners. Thus the Mexican Constitution forbids any and demostrations by foriegners, other than Mexican born and bred, illegal and dealt with it as they saw fit. Unleashing dogs on the demostrators, shooting bullets over the unarmed demostrator's heads. and chasing and beating the demostrators to disburse the demostration. Not only was the Mexican police and Army involved but also the Mexican people, the public persons who wish to stay in Mexico, chasing and abusing any demostrator that was caught. Some of the Mexican police, Army, and public persons were smiling and laughing about the abuse and harassment that they caused to the demostrators. Like it was some kind of trophy to showcase to the world.

Simply put this agenda on the board to allow the Americans to do the same to the illegal aliens here in this nation and they would flee from the horror that awaited them. We watch on the News as an illegal alien runs over our childern in a vehicle with no license, no insurance, no resistration, and not even a " green " card. The vehicle is regestured under another name and they flee the accident scene. In this country they get deported just to return again. In Mexico they get tortured and jail time, and if lucky to live through that then deported. We choose to claim " we are better than the rest of the world with humanity" but the governement debates, which is alot of talking and wasting our time and tax money, on stuff with no end in sight. Yet we also turn a blind eye to what Americans want and need. Our Government has kissed the arse of most countries to keep a good face showing but has allowed the face of American heritage to go to the way side. Our fore-fathers fought and died for this nation to become great and powerful. There are Americans still fighting for this nation to remain great and powerful. This is something that our Government has forgotten. They are to busy fighting each other for some proclaimed "turf" like ganag warfare in L.A. than to see that our American rights are being stepped on and crossed out because of what other than Americans believe. Our Government would rather make the world happy by buying off their needs and wants than to apply this same effort to the American public. We have War Vets living in the streets of our great nation that they served and would have died for because our Government refuses to help them until it's to late, we have childern starving in our nation but would rather feed some other nation's childern to make sure that they grow strong, we have families living in poverty ( not by choice but by design ) because the nation's job market is going else where to find cheap labor, and we all have personal reasons for not wanting or wanting illegals to be here. Reasons that are realivant to only ourselves.
My personal feelings on this is quite simple. If our so called Government can't afford to make the life in America better then they should not attempt to make life better in other lands. Until we are able to " keep our garden free of weeds " then we shouldn't be in someone's elses garden. We as a country have enough problems, internal and external, that need desperate attention and won't go away until shown that attention. Like Social Security, Unemployeement, National deficite, homeless, hungry, rising fuel prices, etc to keep our Gvernemnt busy than to have our very own government out somewhere trying to play " Superman " for every-one else. Our government needs to make a choice...either they are in power for America or they are in power for their own personal fortunes. If it is the latter then they need to find another means to get rich and allow some-one in that cares about the United States of America as much as it's service members do.

I personally think we need to get rid of all our current politicians and their oversized bureaucrat staff's.
We need to get rid of the Republicans and get rid of the Democrats and get some fresh blood in Washington who are dedicated to the betterment of America rather than filling their personal coffers with lobbyist money.
Both sides of the isle can point fingers at each other but the truth is; they are all corrupt!!
I live here in Phoenix and I can't get into my office today because of all the illegals protesting. I could probably find a way but I fear that I would take the opportunity to run a few of them over on the way in.
I just want to know why the INS isn't taking the opportunity to round them up and ship them back home. Hell, all I hear is "how are we going to find all these illegals to deport them?" Well, their all coming out on the streets today identifying themselves for you!!! Just load them up and ship them out!
I had to rent a post office box because the illegals keep breaking into mailboxes trying to lift personal information and social security numbers. The problem here is definitely at a boiling point.
I lived in Texas for 4 years with a hispanic majority population and never had an ill feeling about any group of people but after a year in Phoenix, I absolutely HATE illegal immigrants!!!
The schools in Arizona are ranked 50 out of 50 in the United States and a large reason is all of the Illegal (and Legal) Mexicans and Hispanics who refuse to learn English. You have second Generation Mexican's here who can't speak functional English.
Something needs to be done and if the Politicians in Washington don't want to get off their arses and do something about it then November is our first opportunity to start replacing them!!

GunnyL don't move. Don't let the illegals run you out of town. That means that they win and you lose. I wish I knew how to start a petition against this but being active I am forbidden to do so. I can voice my opinion here but that is all. We can't continue to retreat to safer grounds when the enemy is right at our front door or in the noeghborhood. That is what the Goverenment has done for years now. Look what kind of mess they have wretched upon us all. Lace up your boot straps and get ready to carry on the fight against this BS on the front lines with all your brothers and sisteres that have the same belief. We can't allow these illegals to use our land, money, people, jobs, and government for a get rich quick scheme while America suffers to please them. It is the time to stand up and be counted. Not to turn and walk away while these bastards get ready to knofe us in the back for the hundredth time. I am with you in this 110% and then some. Sometimes what I am trying to say comes out wrong but I hope you can understand it.

I think that I have found the reason all of the Mexicans are invadind the U.S.

A Texan and an Mexican are eyeball to eyeball over a section of border fence. The Mexican is looking daggers of hatred at the American.

Finally, curious, the Texan ask "Just why do you Mexicans hate Americans so bad?"

The Mexican spit on the ground and replied, "We hate you gringos for two reasons! One, you stole half of our country. Two, you stole the half that has all the working telephones and paved roads!"
