Saddam’s lawyers might sue U.S. for war crimes in Iraq
11/23/2004 12:15:00 PM GMT

No lawyer accompanied Saddam when he was brought before an Iraqi court on July 1.

Defense lawyers for the toppled Iraqi leader Saddam Hussein will demand the International Court of Justice to prosecute the Bush Administration for war crimes in Iraq, the defense team spokesman said.

Ziad Khassawneh said that the petition must be signed by a member of the toppled regime because the World Court only hears cases that are forwarded by states and "duly authorized international organs and agencies" as it refuses to hear individual cases.

"Since the World Court doesn't accept cases from individuals, the lawsuit could be filed on behalf of members of President Saddam's government," he said.

He declined to mention any former Iraqi official who might sign such a petition, or say if they were in Iraq or abroad.

The court’s headquarters in The Hague, Netherlands, didn’t react to the potential petition.

Khassawneh also insisted that Saddam remains Iraq's legitimate president due to the "illegality" of last year's U.S.-led invasion. "We insist that Saddam is the legitimate president of Iraq and his government is the only government that represents Iraqis, thus any official of his government is able to petition the court," he said.

He added that the U.S. assault on Fallujah, including the killing of an unarmed and injured Iraqi by a U.S. soldier at a mosque, was "one of scores of examples of American atrocities."

Khassawneh noted that the defense team was also encouraged by UN Secretary-General Kofi Annan's statements that described Iraq's invasion as "illegal."

Saddam's family has hired a multi-national defense team to defend the ousted leader against charges of war crimes and crimes against humanity.

U.S. authorities have banned the legal team or other lawyers from seeing Saddam, who was captured in December 2003 and is being held in a U.S.-controlled prison.

No lawyer accompanied Saddam when he was brought before an Iraqi court on July 1 for an initial hearing on seven indictments of crimes against humanity.

and we should allow him to do so. He can file his lawsuit the day after his execution is carried out!

Saddam is suing? Bu!!sh!t!!! Dead men tell no tales. So what if killing that sucker would have made a martyr out of him. Muslim extremists hate us without him being a martyr! I still dream about the death penalty for him as harnessing him in below a flying CH-46 and smacking him into tall buildings until he's pulp.

Saddam suing? They should have shot him when he was in that hole and filled it with cement, covered it with sand and walked away.
Some mistakes in war you can't go back and fix. This is just such a mistake.
