A Washington County grand jury has cleared a Marine Reserve member of criminal charges in a fatal fight outside a restaurant in Johnson City.
Matthew Ruskins is training with his unit at Camp Pendleton in California before deployment to Iraq.
He returned Wednesday to testify before the grand jury in the January 11th death of Josh King.
King and Ruskins had a confrontation at a restaurant. They and people with them were asked to leave.
The police report states King then rushed Ruskins and put him in a headlock, leading to a struggle in which Ruskins pushed King away. King died when he hit the ground.
District Attorney General Joe Crumley said he was satisfied with the grand jury's decision not to indict.
